We aim to handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, where they apply to us. We may also have obligations under the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth) and other applicable laws.

Depending on how you interact with us, the personal information we collect may include:

transaction, invoice and payment administration information;

website usage, device and technical information; and

any other information you voluntarily provide.

We do not generally require detailed identity documents, bank account credentials, tax file numbers, credit card details, health information or other sensitive information through our general website enquiry forms. If this information is required as part of a formal investment, verification or application process, it should normally be collected directly by the relevant investment issuer, fund manager, financial services provider, property developer, legal adviser, accountant or other authorised party.

Please do not send sensitive or highly confidential information through a general website form, email, social media message or SMS unless we have asked you to provide it using an appropriate method.

3. Sensitive information

Sensitive information includes certain health information, racial or ethnic origin, political opinions, religious beliefs, sexual orientation, criminal history and membership of professional or trade associations or unions.

We will only collect sensitive information where:

you consent to its collection and it is reasonably necessary for our activities;

collection is required or authorised by law; or

another exception under applicable privacy law applies.

For example, you may voluntarily disclose health, accessibility or dietary information when registering for an event or property tour. We will use that information only for the purpose for which it was provided or as otherwise permitted by law.

Bali Property Investment and Women’s Property Investment may provide education, marketing, lead generation and introductions concerning property or investment opportunities. Personal information collected through these brands may be used to connect an interested person with the organisation legally responsible for issuing, offering, selling or administering the relevant opportunity.

6. Financial and investment-related information

If you enquire about an investment opportunity, we may ask for general information about your goals, indicative budget, investment experience, timeframe, property ownership, available cash, equity or potential use of an SMSF.

We use this information to understand your enquiry, provide relevant general information and, where appropriate, introduce you to a licensed or otherwise authorised provider.

Unless expressly stated otherwise, information provided by Bali Property Investment, Women’s Property Investment or King Pixel Digital Marketing is general information and marketing information. It does not take into account your personal objectives, financial situation or needs.

Formal eligibility checks, personal financial advice, product recommendations, identity verification, anti-money laundering checks and investment applications may be undertaken separately by the relevant licensed provider, issuer, trustee, fund manager, developer or professional adviser under its own privacy policy.

7. Direct marketing

Where permitted by law, we may use your contact details to send you information about:

events, webinars and property tours;

Bali property, hotel and resort opportunities;

educational articles, videos, reports and market updates;

project and construction updates;

services provided by King Pixel Digital Marketing; and

other news, services or opportunities that may reasonably interest you.

Marketing communications may be sent by email, SMS, telephone, social media, online advertising or other electronic means.

We will only send electronic marketing communications where we have the required consent or another lawful basis for doing so. Each commercial email or SMS will identify the sender and provide an unsubscribe facility where required.

You may opt out at any time by:

clicking the unsubscribe link in an email;

replying STOP to an SMS where that option is provided;

contacting us using the details at the end of this policy; or

updating your communication preferences where that facility is available.

We will process an unsubscribe request within the period required by law. You may still receive communications that are reasonably necessary to respond to an active enquiry, administer a transaction or provide information you specifically requested.

You may also ask us not to use or disclose your personal information for direct marketing or ask us to identify the source of the information used for direct marketing.

9. Disclosure of personal information

We may disclose personal information to:

our employees, contractors and authorised representatives;

property developers, sales teams, hotel or resort operators and project representatives;

investment issuers, fund managers, trustees, Australian Financial Services Licence holders and their authorised representatives;

lawyers, accountants, financial advisers, SMSF advisers and other professional service providers;

regulators, courts, law-enforcement bodies and government agencies where required or authorised by law;

a purchaser, successor or adviser involved in a proposed or completed sale, restructure or transfer of our business or assets; and

other parties where you have consented to the disclosure or would reasonably expect it.

We do not sell personal information as a standalone commercial product.

Where we refer or introduce you to an external organisation, that organisation may collect and manage your information under its own privacy policy. You should review that policy before providing detailed personal, financial or identity information.

10. King Pixel Digital Marketing client data

When King Pixel Digital Marketing provides marketing services to a business client, it may process personal information on that client’s behalf, including enquiry, advertising, CRM, customer or campaign data.

In those circumstances:

the client may be primarily responsible for deciding why and how the information is collected and used;

King Pixel Digital Marketing will use the information to provide the agreed services and for related administrative, security and legal purposes;

we may use approved service providers to deliver those services; and

individuals may need to direct privacy enquiries to the relevant client in the first instance.

We take reasonable steps to handle client-controlled personal information consistently with our contractual and legal obligations.

11. Overseas disclosure and storage

Some of our business partners, property projects and service providers are located outside Australia.

We are likely to disclose personal information to recipients located in:

Indonesia, including Bali-based property developers, project representatives, hospitality businesses and operational partners; and

the United States, where a number of technology, advertising, analytics, CRM, email and cloud service providers are based.

Information may also be processed or stored in other countries in which our technology and cloud service providers or their subcontractors operate. These locations may change from time to time and may include countries in the Asia-Pacific region, the United Kingdom, the European Union and other regions.

Before disclosing personal information overseas, we will take reasonable steps required by applicable Australian privacy law. However, overseas recipients may be subject to different privacy laws and regulatory requirements from those applying in Australia.

By choosing to deal directly with an overseas property developer, hotel operator or other overseas organisation, you may also provide personal information directly to that organisation under its own privacy practices.

12. Social media and third-party websites

Our websites and communications may contain links to third-party websites, applications or social-media platforms.

We are not responsible for the privacy practices, security or content of third-party services. Your interaction with those services is governed by their terms and privacy policies.

Information posted publicly on our social-media pages, in comments, reviews or public forums may be visible to other users. You should avoid publishing confidential, financial or sensitive information in a public area.

13. Testimonials, photographs and recordings

We will obtain appropriate permission before publishing an identifiable testimonial, photograph, video or recording for promotional purposes.

Investor events, tours and presentations may be photographed or recorded. Where practical, attendees will be notified, and reasonable steps will be provided for anyone who does not wish to appear in promotional material.

You may withdraw permission for future use by contacting us. Withdrawal will not necessarily require us to recall material that has already been lawfully printed, published or distributed.

14. Anonymity and pseudonyms

Where practical, you may interact with us anonymously or using a pseudonym.

However, we may need your correct identity and contact details to:

respond to a specific enquiry;

register you for an event or tour;

arrange an appointment or introduction;

enter into or administer an agreement;

process a payment;

meet legal or regulatory requirements; or

refer you to an investment issuer or licensed provider.

15. Data quality

We take reasonable steps to ensure the personal information we use and disclose is accurate, up to date, complete and relevant.

Please tell us if your contact details or other information change or if you believe the information we hold about you is incorrect.

Personal information may be held electronically or, in limited circumstances, in physical records.

We take reasonable technical and organisational measures to protect personal information against misuse, interference, loss and unauthorised access, modification or disclosure. These measures may include:

No internet transmission or electronic storage system is completely secure. We cannot guarantee the absolute security of information transmitted electronically.

17. Data retention

We retain personal information for as long as reasonably necessary for the purpose for which it was collected, to manage our relationship with you and to comply with legal, accounting, taxation, insurance and regulatory obligations.

Retention periods may vary depending on the type of information and the reason it is held.

When personal information is no longer required and we are not legally required to retain it, we will take reasonable steps to destroy it securely or permanently de-identify it.

We may retain de-identified or aggregated information for analytics, planning and reporting where that information no longer identifies an individual.

We maintain procedures for responding to suspected privacy and security incidents.

If a data breach is likely to result in serious harm and the Notifiable Data Breaches scheme applies, we will take appropriate steps, which may include notifying affected individuals and the Office of the Australian Information Commissioner.

19. Accessing your personal information

You may request access to personal information we hold about you by contacting our Privacy Officer.

We may need to verify your identity before providing access. We will respond within a reasonable period.

In some circumstances, the law allows or requires us to refuse access or limit the information provided. If we refuse a request, we will generally provide written reasons and information about available complaint mechanisms, where required.

We will not charge you for making an access request. We may charge a reasonable fee for costs associated with providing access where legally permitted, but we will notify you before incurring that cost.

20. Correcting personal information

You may ask us to correct personal information that you believe is inaccurate, out of date, incomplete, irrelevant or misleading.

We will take reasonable steps to correct the information where appropriate. If we refuse to make a requested correction, we will generally explain why and provide information about available complaint mechanisms, where required.

21. Privacy complaints

If you believe we have breached your privacy or mishandled your personal information, please contact our Privacy Officer in writing and provide:

a description of your concern;

relevant dates or communications; and

the outcome you are seeking.

We will acknowledge and investigate your complaint and aim to provide a response within 30 days. If we require additional time, we will let you know.

22. Children

Our services and investment-related content are intended for adults and are not directed to children under 18.

We do not knowingly seek to collect personal information from children without the involvement of a parent or guardian. If you believe a child has provided personal information to us, please contact our Privacy Officer.

23. Automated processing

We may use software to organise enquiries, record interactions, segment audiences, prioritise follow-ups, personalise communications or trigger administrative and marketing workflows.

We do not currently use personal information in a solely automated process to make decisions that could reasonably be expected to significantly affect an individual’s legal rights, contractual rights or access to a significant service.

Formal decisions regarding investment eligibility, acceptance, financial products, lending or advice are made by the relevant issuer, licensed provider, financial institution or other responsible organisation under its own processes and privacy policy.

If our use of automated decision-making changes, we will update this policy as required by law.

24. Changes to this Privacy Policy

We may update this Privacy Policy when our practices, systems, service providers, business structure or legal obligations change.

The current version will be published on our websites with the date it was last updated. We encourage you to review it periodically.

Material changes may also be communicated through our websites or other appropriate channels.
